Experience

Accrued in a career spanning in excess of 30 years, Peter has wide-ranging experience in law and specialises in the area of payroll tax law.

As payroll tax is a state-based tax, Peter has a thorough understanding of payroll tax law in all states and territories and how businesses operating across borders and in multiple jurisdictions can structure their businesses effectively.

Peter has been involved in helping businesses of many sizes and across many industries, to restructure their operations to minimise payroll tax obligations. He can advise on the most suitable structure for a business particularly with regard to companies and trusts.

Peter has advised clients on applications for de-grouping or exclusion of businesses from grouping under the Payroll Tax Act in many states and territories. His expertise is highly sought after to assist clients during audits by the Office of State Revenue and he has represented clients in litigation with the OSR. He regularly makes representations on behalf of clients to the OSR which have resulted in clients saving many millions of dollars in payroll tax payments.

  • Acting for a national company in reducing several payroll tax assessments from $9m to nil
  • Successfully making various applications for de-grouping of companies where two or more of their businesses were grouped for payroll tax
  • Representing a large property developer in negotiating with the OSR on ensuring payments to contractors were not subject to payroll tax
  • Making representations to the OSR that the employment agency provisions did not apply to a large service company even though they contracted other companies to carry out the work under their contracts with customers
  • Convincing the OSR that the contractor provisions did not apply to payment of management fees between companies
  • Successfully objecting to payroll tax assessments where tax was imposed on payments to various contractors engaged by the client
